Applicable fees

The applicant for a community plant variety right shall pay this application fee at the date of the processing application.

The examination fees are fixed under the current fees regulation . The fees due to be paid for each growing period depends on which species your variety belongs to. The range is from 1160 Euros up to 2500 Euros. Each species is attributed to one of the 29 cost groups as detailed in the Annex I below. The complete list of species with the relevant cost group can be found  Annex II and for the most important species in the special issue S2 of the CPVO’s Gazette.

Where the Office makes use of a report on the result of a technical examination of a variety carried out previously for official purposes in a Member State a fee for taking over reports.

For the years 2006-2008, the annual fee has been set at a flat rate of 200 Euros per variety and per year of protection. For the years 2009 and following ones, the annual fee has been set at a flat rate of 300 Euros per variety and per year of protection.

1/3 of the appeal fee is due from the appellant on the date of receipt of the appeal by the Office. The remaining 2/3 is due, upon request of the Office, within 1 month after remittal of the case to the Board of Appeal.

(a)

An application for a compulsory exploitation right,

including any entries in the Registers, an application for an exploitation right to be granted by the Office pursuant to Article 100 (2) of the Basic Regulation, or a request to amend such exploitation rights, once granted, (compulsory licence fee), save for the Commission or a Member State in the circumstances referred to in Article 29 (2) .

(b)

A request for the following entries into the Register, of

Community plant variety rights (Register fee)

• transfer of a Community plant variety right, contractual exploitation right,
• Identification of varieties as initial or essentially derived,
• Institution of actions in respect of claims referred to in Articles 98 (1), (2) ( transfer of entitlement in a civil law claim) and 99 of the Basic Regulation (acknowledgement of an essentially derived variety )
• Community plant variety right given as a security or as the subject of rights in rem, or
• Any levy of execution as referred to in Article 24 of the Basic Regulation

(c)

A request for any entry into the Register of Applications

for Community plant variety rights or the Register of Community plant variety rights, other than those referred to in (a) and (b) above.

(d)

A request for determining the amount of costs pursuant

to Article 85 (5) of the Basic Regulation.

(a)

Delivery of an extract from the Register of Applications

of the Community Plant Variety Rights :
20 Euros for up to 10 pages and 1 Euro per page thereafter.

b)

Issue of non-certified copies of documents relating to

an application for, or the grant of, a Community Plant Variety Right :
10 Euros for up to 10 pages and 1 Euro per page thereafter.

c)

Issue of certified copies of documents relating to an

application for, or the grant of, a Community Plant Variety Right :
20 Euros for up to 10 pages and 1 Euro per page thereafter.

Important Notice:

d) Subscription to the Official Gazette of the Community Plant Variety Office :

(i) 80 Euros for an annual subscription; and
(ii) 15 Euros per issue for a single issue or a back issue.

e) Subscription to the Annual Report of the Community Plant Variety Office

(i) 20 Euros for an annual subscription; and
(ii) 15 Euros per issue for a single issue or a back issue.
